Missouri Lien Services, LLC (MoLiens) was established to help Missouri’s construction businesses preserve and enforce their mechanic’s lien rights and thereby get paid. MoLiens was formed in response to RSMo §429.016 which radically altered the procedure for establishing mechanic’s lien claims in Missouri. Under the new law, a potential lien claimant can lose its lien rights before it even completes its work on the project.
We recommend that material suppliers and subcontractors file a “Notice of Rights” at the beginning of every arguably residential project. “Residential property” is broadly defined in the new law to include apartments, condominiums, townhouse, and appurtenances thereto. Residential property is no longer limited to occupied premises of four units or less.
Our office will file your company’s Notice of Rights. For us to do so, you must complete the Project Information Sheet on a per job basis and get it to us. MoLiens will then prepare and record your company’s “Notice of Rights.” If the Lien Claimant still is not paid, then the Lien Claimant must still file a Mechanic’s Lien within the time allowed under the former law. Under the new law there are serious consequences for not timely releasing the “Notice of Rights,” therefore MoLiens will also ensure that the “Notice of Rights” is properly released once the claimant has been fully paid.
